Climate Litigation and Youth Movements in India: Emerging Jurisprudence

Abstract In recent years, India has witnessed a growing intersection between climate litigation and youth-led activism. Young citizens, recognizing the existential threat posed by climate change, have increasingly sought to use the judiciary as a forum to enforce environmental rights and compel state action. This article examines the emergence of climate jurisprudence in India, focusing on the role of youth movements in shaping legal discourse and policy. It critically analyzes landmark cases, including petitions under the Public Interest Litigation (PIL) framework, and situates them within the broader context of international climate obligations. By exploring legal strategies, judicial reasoning, and the socio-political impact of youth-led climate movements, this study identifies emerging principles in Indian environmental jurisprudence, including the enforceability of the right to a healthy environment, intergenerational equity, and climate accountability. The paper concludes with policy recommendations to strengthen participatory mechanisms and institutionalize youth engagement in climate governance.
