| Abstract | Cyberspace is a virtual environment with no concrete boundaries, which distinguishes it from the real world. This fact is significant when discussing personal jurisdiction because the physical boundary is usually an important criterion in determining jurisdiction. The state sovereignty debate is raging over whether or not the usual rule should still apply to Cyberspace, and whether a new standard should be established to replace it. The jurisdiction issue in Cyberspace is very unpredictable due to the various approaches taken by different state sovereignties in light of the current circumstance involving the physically out-of-state defendant. Different techniques to dealing with the jurisdictional issue of physically out-of- state defendants in various state sovereignties are discussed here. The process of adjudication and the means for enforcing it in any legal system and, as a result, any adjudication process rely on territorial ideas that are far more superficial in cyberspace world. The paper takes a fairly practical approach to determining the outcome. |
