From Legal Rights to Lived Realities: Evaluating the Gap between Gender Justice Jurisprudence and Scientific Citizenship Outcomes in Contemporary India

Author(s) Moonam Hitesh Kharat
Country India
Abstract Indeed, the rich jurisprudence on gender justice in India notwithstanding, there remains a disconnect between the legal discourse and women's citizenship experiences. This paper critically considers this gap through an analysis of the translation (or non-translation) of constitutional principles, legal provisions and judicial interpretations into social reality. Rooted in the ethos of scientific temper as envisaged in Article 51A(h) of the Constitution of India, the research redefines citizenship as not just a legal but an evidence-based self-empowered capacity for social engagement and rational autonomy
